A Kildare County district judge in Ireland is expressing “serious concerns” for a 16-year-old boy in State care who is facing statutory rape charges after having consensual sex with a female who’s the same age as he is.

At Naas District Court, the teen student appeared on three charges of criminal damage in Kildare County on April 4th, 5th and 6th of 2015.

At a previous appearance in court, Judge Desmond Zaidan had given him a warning to complete his Junior Certificate following charges of criminal damage. Now he’s facing charges of having sex with a girl at an event in Dublin County while on bail for criminal damage charges.

The court was told about how the girl, who isn’t in state care, went home and told her parents that the two had had consensual sexual contact. The parents objected to the boy being in a relationship with their daughter because they came from a “decent family” and called authorities to press charges.

In court, the defense agreed with Judge Zaidan when he said, “Someone has to guide him and be firm. Someone has to give him love. His parents have let him down.”

The judge read a report that showed the accused boy has a borderline personality disorder that affects his intellectual capacity and is having a “profound effect on his vulnerability to a negative peer group.”

“He is easily taken advantage of and needs the protection of the state,” the judge continued.

He warned solicitor for the State Shane Reynolds that he has “serious concerns” for the boy’s personal welfare.

“I don’t think he understands what is going on,” he said.

Inspector Mel Smith didn’t object to granting the teen boy bail.

The judge kept him in custody on continued bail until his appearance in District Court on the criminal damage charges.
