30-year-old Robert Leroy Wilson of Maryland was charged Wednesday with first-degree assault, child abuse and reckless endangerment after he allegedly handcuffed and beat his girlfriend’s 9-year-old son, Jack Garcia, until he became unconscious because he had eaten a piece of birthday cake without asking permission. It occurred on June 30th.

When rescue services arrived at the home after the first call, police say the child’s mother told paramedics that her son was simply congested. She denied her son medical attention for approximately 4 hours.

Paramedics were called back to the home after the child stopped breathing. The boy was transferred to the Children’s National Hospital in Washington, D.C. where he later died.

The Hagerstown Police wrote in a press release posted to their Facebook page, “The juvenile was found to have numerous bruises, contusions and abrasions on the following areas of his body; face, neck, back, buttocks, legs and abdomen.”

Wilson is being held at the Washington County Detention Center on a $600,000 bond and he is scheduled to appear in court on July 30th for a preliminary hearing.
