30-year-old Robert Leroy Wilson of Maryland was charged Wednesday with first-degree assault, child abuse and reckless endangerment after he allegedly handcuffed and beat his girlfriendâ€™s 9-year-old son, Jack Garcia, until he became unconscious because he had eaten a piece of birthday cake without asking permission. It occurred on June 30th.
When rescue services arrived at the home after the first call, police say the childâ€™s mother told paramedics that her son was simply congested. She denied her son medical attention for approximately 4 hours.
Paramedics were called back to the home after the child stopped breathing. The boy was transferred to the Childrenâ€™s National Hospital in Washington, D.C. where he later died.
The Hagerstown Police wrote in a press release posted to theirÂ FacebookÂ page, “The juvenile was found to have numerous bruises, contusions and abrasions on the following areas of his body; face, neck, back, buttocks, legs andÂ abdomen.â€
Wilson is being held at the Washington County Detention Center on a $600,000 bond and he is scheduled to appear in court on July 30th for a preliminary hearing.
