Prosecutors in Indiana are none too happy with a judge that allowed a father to walk away with nothing but probation after molesting his daughter.
41-year-old Jeremy Schwer won’t spend a minute in jail, even after admitting to molesting his 6-year-old daughter while she had cancer.
According to court documents, he’d made his daughter touch his genitals, and he’d touched hers. The abuse began about two years ago, and continued on nights that he spent with his daughter at the hospital, and continued when she was cleared to go home.
He pleaded guilty to felony child abuse after sexually abusing his daughter while she was recovering from a brain tumor.
He has two daughters with his wife of eight years, and it was his oldest that he molested.
Prosecutor Courtney Curtis had asked the judge to sentence him to at least nine years in prison, but the Marion County Superior Court judge sentenced him to 12 years probation instead.
His estranged wife, who’s filed for divorce after she calling child protective services about the abuse, asked the court to spare him from jail because she needed the financial support for their children.
Along with the 12 years probation, he has to register as a sex offender, leave the family home, and enter a counseling program.
John Campbell, his attorney, says that the father has committed to dedicate his life to support his family.
