SMELL OF WEED COST LENOIR MAN HIS VEHICLE

MOONSHINEOn November 18, 2013 at about 5:00 p.m., CCRT (Community Crime Reduction Team) Deputy Josh Stocks was on patrol and had stopped at the intersection of NC 11 and NC 55 West, Kinston. Deputy Stocks noticed that the vehicle (2002 Chev Silverado truck) was displaying an expired tag registration. Stocks stopped the vehicle and began to converse with the driver. The driver was identified as Joshua Andrew Rouse, age 22, of 232 Regan Drive, Kinston. During the conversation Deputy Stocks smelt the

odor of burning marijuana and confronted Rouse. Rouse admitted to smoking marijuana in the vehicle but that all of the illegal plant material had been consumed. A search was conducted of the vehicle. During the search Deputy Stocks seized a smoking pipe and then observed a gallon jug of a substance which Rouse had indicated was “moonshine.” Deputy Stocks seized the illicit beverage and charged Rouse with Possessing non-tax paid liquor, possess for sale non-tax paid liquor, and possession of drug paraphernalia. Rouse was charged on a citation and released. In addition, under the law, Rouse lost ownership of his vehicle, which was impounded.

Sheriff Hill stated, “Under the law any amount of non-tax paid liquor is illegal to possess. Of greater importance is that any amount of illegal liquor transported in a motor conveyance subjects that conveyance to seizure and public sale. The proceeds from the sale of the vehicle will go to the school system.”
